In a victory for the Liberal government, the federal Court of Appeal has upheld its decision to list plastics as toxic, enabling Ottawa to ban single-use plastic items.

The decision is a blow to Canada’s plastics industry, which had challenged federal government rules aimed at curbing plastic pollution.

The unanimous decision of the Federal Court said a judge had made a mistake when he ruled that Ottawa’s decision to list plastic items as toxic was “unreasonable and unconstitutional”.

Three appeals court judges said the ruling was “Based on false grounds” and did not infringe provincial or territorial jurisdiction.

“There is no constitutional issue here,” the ruling said.

The court also found that the government’s decision was justified as plastic has the potential to be toxic to humans and the wider environment.
