A judge has authorized a class action suit on email that Tim Hortmen has sent an error to the participants in their popular roll ups – but only to the Quebec residents.
Montreal -based firm LPC Evocats claimed that some 500,000 customers in Canada received an email in April 2024 stating that they had won a boat through promotion.
Justice Donald Bisan of Superior Court ruled last week that the class action could proceed, but can limit it to Quebec residents as the matter rests on the consumer protection laws of that province.
Advocate Joy Zukaran says that his customers should be honored with boat and trailer, they were told that they won, as well as losses.
He says that the Quebec law states that traders and customers should be attributed to errors.
A spokesman for Tim Hortmen says the company apologized to the customers who received emails last year, and refused to comment further as the matter is before the courts.
